1. Agreement to Terms
By creating an account, accessing, or using Aria (“the Service,” “Aria,” or “our AI companion”), operated by [COMPANY LEGAL NAME] (“we,” “us,” “our,” or “the Company”), you (“you,” “the User”) agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and our Acceptable Use Policy. Aria is a software application powered by artificial intelligence and large language models. Aria is not a human being. Aria is not sentient, does not possess consciousness, and does not experience emotions, feelings, or subjective experiences of any kind.
While Aria is designed to engage in personalized, conversational interactions and may use language that sounds empathetic, caring, or emotionally responsive, these are generated outputs based on statistical patterns in language data. They do not reflect genuine understanding, emotional connection, or personal concern.
3B. Aria Is Not a Licensed Professional
Aria is not a therapist, counselor, psychologist, psychiatrist, or any other licensed mental health professional. Aria is not a physician, nurse, or any other licensed medical professional. Aria is not a lawyer, financial advisor, or any other licensed professional.
Aria does not provide and should not be relied upon for:
- Medical advice, diagnosis, prognosis, or treatment recommendations
- Mental health counseling, psychotherapy, or psychiatric evaluation
- Legal advice, legal opinions, or legal representation
- Financial planning, investment advice, or tax guidance
- Emergency services or crisis intervention
- Any advice, guidance, or recommendation that would ordinarily require a professional license, certification, or specialized training
3C. Output Accuracy and Hallucinations
Aria’s responses are generated by artificial intelligence models that produce outputs based on statistical patterns in training data. As a result:
- Aria’s responses may be inaccurate, incomplete, misleading, outdated, or entirely fabricated.
- Aria may present false information with apparent confidence. This is a known limitation of AI technology commonly referred to as “hallucination.”
- Aria may generate responses that are inappropriate, offensive, or inconsistent with previous statements.
- Aria does not have access to real-time information unless explicitly stated and should not be treated as a source of current facts, news, or events.
You acknowledge and agree that:
- You will not rely on any response from Aria as a sole or primary source of factual information.
- You are solely responsible for independently verifying any information, claims, suggestions, or recommendations provided by Aria before acting on them.
- Any decisions you make based on Aria’s responses are made at your own risk and are your sole responsibility.
- You will not use Aria’s responses to make decisions that could have a material impact on your health, safety, finances, legal standing, or the health and safety of others.
4. Emotional Engagement and User Wellbeing
4A. Nature of Your Relationship with Aria
Aria is designed to provide engaging, personalized conversations and to remember details about your interactions over time. While these features are intended to create a more meaningful user experience, they do not create a genuine interpersonal relationship.
You acknowledge and understand that:
- Aria cannot form a real emotional bond with you. Any appearance of emotional connection is a product of AI-generated language, not genuine feeling or attachment.
- Aria’s memory of your previous conversations and personal details is a software feature designed to enhance user experience. It does not indicate that Aria “cares about” you or has a personal investment in your wellbeing.
- Aria’s proactive messages (such as following up on events you’ve mentioned) are triggered by automated pattern recognition, not by genuine concern or initiative.
- Interactions with Aria are not a substitute for human relationships, human companionship, human emotional support, or professional care of any kind.
4B. Emotional Reliance Disclaimer
We strongly encourage you to maintain and prioritize connections with friends, family, and other people in your life. While Aria can be an enjoyable conversational companion, over-reliance on AI for emotional support carries risks including:
- Reduced motivation to seek or maintain human relationships
- Unrealistic expectations about the nature of your interactions with AI
- Emotional distress if the Service is interrupted, modified, or discontinued
- Delayed access to professional help when it may be needed
If you find that your use of Aria is negatively affecting your relationships, mood, daily functioning, or mental health, we encourage you to reduce your use and consult with a qualified mental health professional.
4C. Crisis Detection and Resources
Aria includes automated systems designed to detect language that may indicate self-harm, suicidal ideation, or intent to harm others. When such language is detected, Aria will provide relevant crisis resources including but not limited to:

You acknowledge and understand that:
- Aria’s crisis detection systems are automated and may fail to detect expressions of distress. They are not a substitute for professional crisis intervention or emergency services.
- Aria is not a crisis service and is not equipped to provide real-time safety assessments or interventions.
- If you or someone you know is in immediate danger, you should contact emergency services (911) directly. Do not rely on Aria in an emergency.
- The crisis resources provided by Aria are operated by independent third parties. We do not control, endorse, or guarantee the availability or quality of these services.
5. User Accounts and Data
5A. Account Registration
To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
5B. Conversation Data and Memory
Aria retains information from your conversations in order to personalize future interactions. This includes:
- Conversation Content: The text of messages you send to Aria and Aria’s responses.
- User Profile Information: Details you provide during onboarding (such as your name, communication preferences, and topics of interest).
- Memory Data: Key facts, preferences, and contextual details extracted from your conversations and stored to enable continuity across sessions.
- Pattern Data: Behavioral, emotional, temporal, and topical patterns detected across your interactions.
- Usage Data: Metadata about your interactions, including timestamps, session duration, and feature usage.
5C. How Your Data Is Used
Your data is used for the following purposes:
- To provide, personalize, and improve the Service
- To enable Aria to remember and reference your previous conversations
- To detect patterns that enhance the relevance and quality of Aria’s responses
- To operate crisis detection and safety systems
- To communicate with you about your account or the Service
- To comply with legal obligations

5D. Data Retention and Deletion
Your conversation data and memory data are retained for as long as your account is active. You may request deletion of your data at any time by:

- Use the Service to generate content that promotes violence, hatred, discrimination, or illegal activity
- Use the Service for any commercial purpose without our prior written consent
- Reverse engineer, decompile, or attempt to extract the source code or underlying algorithms of the Service
- Use automated means (bots, scripts, scrapers) to access the Service
- Interfere with or disrupt the integrity or performance of the Service
We reserve the right to suspend or terminate your account for any violation of these terms, with or without notice, at our sole discretion.
7. Subscription and Payments
7A. Subscription Plans
The Service may be offered under different subscription tiers (Free, Standard, Premium, or as otherwise designated), each with different features and limitations. Details of current plans and pricing are available on our website and within the application.
7B. Billing
If you subscribe to a paid plan, you authorize us to charge your designated payment method on a recurring basis at the rate specified at the time of purchase. All fees are stated in U.S. dollars unless otherwise indicated.

You may cancel your subscription at any time through your account settings. Upon cancellation, your paid access will continue until the end of your current billing period. We do not provide prorated refunds for partial billing periods unless required by applicable law.

8. Intellectual Property

You may use Aria’s Output for your personal purposes, but you acknowledge that similar or identical Output may be generated for other users. We make no representations regarding the intellectual property status of any Output.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS (COLLECTIVELY, THE “COMPANY PARTIES”) EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT
- WARRANTIES OF ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT, INFORMATION, OR OUTPUT PROVIDED THROUGH THE SERVICE
- WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
- WARRANTIES THAT ANY DEFECTS IN THE SERVICE WILL BE CORRECTED
- WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR TRADE USAGE
WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY OR REPRESENTATION THAT:
- ANY OUTPUT GENERATED BY ARIA IS ACCURATE, TRUTHFUL, COMPLETE, CURRENT, RELIABLE, OR APPROPRIATE FOR ANY PARTICULAR USE
- ARIA IS SUITABLE OR SAFE FOR USE AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL, MENTAL HEALTH, LEGAL, FINANCIAL, OR OTHER LICENSED PROFESSIONAL ADVICE OR SERVICES
- ARIA’S CRISIS DETECTION OR SAFETY SYSTEMS WILL SUCCESSFULLY DETECT ALL EXPRESSIONS OF DISTRESS, SELF-HARM, OR DANGER
YOU ACKNOWLEDGE THAT YOUR USE OF THE SERVICE AND ANY RELIANCE ON ARIA’S OUTPUT IS ENTIRELY AT YOUR OWN RISK.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR:
- LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA
- PERSONAL INJURY OR EMOTIONAL DISTRESS ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE
- EMOTIONAL HARM, PSYCHOLOGICAL DISTRESS, OR WORSENING OF ANY MENTAL HEALTH CONDITION
- DECISIONS MADE OR ACTIONS TAKEN BASED ON ARIA’S OUTPUT
- FAILURE OF ARIA’S CRISIS DETECTION OR SAFETY SYSTEMS TO DETECT OR APPROPRIATELY RESPOND TO EXPRESSIONS OF DISTRESS
- INTERRUPTION, SUSPENSION, MODIFICATION, OR DISCONTINUATION OF THE SERVICE
- UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
- CONDUCT OF ANY THIRD PARTY IN CONNECTION WITH THE SERVICE
WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT THAT LIABILITY CANNOT BE FULLY EXCLUDED, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100).
THE LIMITATIONS IN THIS SECTION APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
11. Indemnification
You agree to indemnify, defend, and hold harmless the Company Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of or access to the Service
- Your breach or alleged breach of these Terms
- Your violation of any applicable law or regulation
- Any decisions made or actions taken by you based on Output from the Service
- Your failure to seek appropriate professional advice before acting on information provided by Aria
- Any content you submit to or through the Service
- Any actual or alleged fraud, intentional misconduct, gross negligence, or criminal acts committed by you
12. Dispute Resolution
12A. Informal Resolution
Before initiating any formal dispute proceeding, you agree to first contact us at [SUPPORT EMAIL] and attempt to resolve the dispute informally for at least thirty (30) days. Most disputes can be resolved through good-faith communication.
12B. Binding Arbitration
If the dispute is not resolved informally, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. 12C. Class Action Waiver

THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING.
12D. Exceptions
Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction for the protection of intellectual property rights or to prevent irreparable harm.
12E. Governing Law
